What is Nikāḥ al-Misyār, and is it permissible in Islam?
Nikāḥ al-Misyār (Arabic: زواج المسيار) is a form of marriage practiced in some Arab societies. From a Sharʿī (Islamic legal) perspective, it is similar to a regular marriage, with the distinction that certain marital rights are mutually waived by the husband and wife, such as:
◈ The wife’s right to maintenance (nafaqah)
◈ The right to live together
◈ The right to equal nightly turns
Nikāḥ al-Misyār is considered valid if all the essential Islamic conditions and pillars of marriage are fulfilled, including:
◈ Presence of a guardian (walī)
◈ Mutual consent of both spouses
◈ Two witnesses
◈ Public announcement of the marriage
The Prophet ﷺ said:
“Among all conditions, the most worthy of being fulfilled are those by which the private parts become permissible.”
[Ṣaḥīḥ al-Bukhārī]
Historically, such forms of marriage also existed, where men would impose conditions such as:
◈ Not dividing time equally between wives
◈ Not taking responsibility for housing or expenses
◈ Visiting the wife only during the day (referred to as "al-Nahāriyyāt")
Islamic jurists have differed on the permissibility of Nikāḥ al-Misyār:
✔ Some scholars disliked it,
✔ But did not declare it ḥarām, as long as the Sharʿī conditions are fulfilled.
In Muṣannaf Ibn Abī Shaybah, it is narrated from Ḥasan al-Baṣrī and ʿAṭāʾ ibn Abī Rabāḥ that they saw no harm in “daytime-only marriages.”
From ʿĀmir al-Shaʿbī, it is narrated that there is no harm if a man stipulates that he will spend the day with one wife and the nights with another.
Several contemporary scholars have issued fatāwā of permissibility for Nikāḥ al-Misyār, including:

✔ Shaykh Ibn ʿUthaymīn رحمهم الله
