Is it permissible to make residential arrangements for scholars above mosques?
✦ It is legally permissible to construct residential accommodations above the shops or washrooms attached to a mosque.
However, building residences directly above the main prayer area of the mosque is not appropriate. The sanctity and primary function of the mosque's worship space require it to remain undisturbed and dedicated solely to acts of worship.
If the residential structures are built over annexed parts of the mosque—such as attached commercial shops or ablution areas—then this arrangement is acceptable and does not violate the mosque’s sanctity.
