Selling and Buying of Waqf Land

If the benefits and uses of waqf land have ceased entirely, and no one can benefit from them anymore, then it is permissible to sell such land and use its price for something that will bring benefit.


However, if its interests and benefits still exist, then it is not permissible to sell it, and it will remain waqf. Additionally, in the first scenario—where selling it is permissible—it is necessary to refer to the relevant Shariʿah authorities so that waqf properties do not become a plaything in the hands of people. Otherwise, everyone would claim that its benefits have ended and start selling it according to their own desires.

Summary:
When the benefits of waqf land have ended, selling it is not just permissible—it is obligatory—so that the waqf can continue to provide benefit. However, if its benefits remain, it will continue to exist as it was originally intended.
