Shari'ah Ruling on Falsely Claiming Illness to Give Testimony

Author: Dr. Muhammad Zia-ur-Rahman A‘zami (رحمه الله)

❖ Ruling on Fabricating Testimony of Illness to Justify Absence from Work

The ruling concerning such witnesses is that their act is haram (forbidden), as it constitutes falsehood and fabrication.

Allah (سبحانه وتعالى) says:

«فَاجْتَنِبُوا الرِّجْسَ مِنَ الْأَوْثَانِ وَاجْتَنِبُوا قَوْلَ الزُّورِ»

[Surah al-Ḥajj: 30]
"So avoid the filth of idols and avoid false speech."

The Messenger of Allah (ﷺ) said:
“Shall I not inform you of the most grievous of the major sins? They are three: associating partners with Allah, disobedience to parents...”
He (ﷺ) was reclining, then he sat up and said:
“Behold! False speech, behold! False testimony.”
He continued repeating it until we said, "If only he would stop!"
[Ṣaḥīḥ al-Bukhārī, Ḥadīth 5976; Ṣaḥīḥ Muslim 87/143]

[اللجنة الدائمة: 3577]

Thus, concocting a false claim of illness in order to support an absence from work through fabricated testimony is a major sin, and it falls under the category of false testimony (qawl az-zūr), which is strictly condemned in Islam.
