Shar'i Ruling on Daytime Intercourse and False Beliefs About Childbirth

Is It Permissible to Have Intercourse with One’s Wife During the Day? Shar'i Ruling and False Beliefs

Source: Aḥkām wa Masāʾil – Masāʾil al-Nikāḥ, Vol. 1, p. 324

❖ Question

Is it permissible for a husband to have intercourse with his wife during the day? Some scholars say that if intercourse is done during the day, the child will be born cross-eyed. Is this correct?

❖ Answer

Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, Ammā baʿd!

It is absolutely correct that a husband can have intercourse with his wife during the day, provided that he is not fasting and there is no other Shar'i prohibition.

Allah ﷻ says in the Qur’an:

﴿ أُحِلَّ لَكُمۡ لَيۡلَةَ ٱلصِّيَامِ ٱلرَّفَثُ إِلَىٰ نِسَآئِكُمۡۚ ﴾
(Sūrah al-Baqarah, 187)

"It has been made permissible for you, during the nights of fasting, to have intimate relations with your wives."

From this verse, it is clear that intimacy is allowed at night during fasting. Thus, when one is not fasting, it is also permissible during the day, unless some other Shar'i restriction applies.

✿ Regarding the Claim of Some Scholars

Some individuals say that “having intercourse during the day causes the child to be born cross-eyed.”

This claim is entirely false and baseless.

There is no question of its correctness, because it is not correct at all.

If one were to claim such a thing, then should it also be said that a child conceived at night would be born blind? This clearly shows the absurdity of such statements.

For people of intellect and understanding, this is a point to reflect upon. Such claims are nothing but a decline of reason and wisdom.

May Allah grant us all true understanding.
