Shari‘ah Ruling on Forced Divorce, Khula‘, and Revocation – Complete Guidance

I married of my own choice three years ago. About a year and a half ago, at my parents’ insistence, I went to court where a lawyer had me sign a prepared document. This document falsely stated that the divorce was being given at the wife’s request for khula‘, even though my wife never requested it. It also stated that three divorces were issued at once.
Later, I moved to Islamabad for work, and a week later my wife joined me. We have been living together ever since.
Meanwhile, my parents arranged another marriage for me, and after the nikah they made me write on the form that I was already divorced from my first wife.
Now I want to know:
❀ Has divorce from my first wife actually taken place?
❀ My wife never received any divorce notice.
❀ We cannot live without each other.

1. Khula‘ Claim Was False
- Since your wife never requested khula‘, and the process was carried out under parental pressure with a pre-prepared statement from the lawyer, this khula‘ is not valid in Shari‘ah.
2. Shari‘ah Status of Forced Divorce
- If the action was forced upon you, meaning you had no intention in your heart to issue a divorce and signed only under pressure:
- Such a forced divorce does not take effect in Shari‘ah.
- Not even a single divorce would have occurred.
3. If You Agreed Willingly
- If you willingly agreed at your parents’ request and signed the divorce document prepared by the lawyer:
- One revocable divorce (talaq raj‘i) has taken place.
- After a revocable divorce, you can take your wife back (ruju‘) during the waiting period (‘iddah).
4. Revocation and Its Validity
- Since your wife came back to you a week later and you resumed living together:
- This constitutes a valid ruju‘ in Shari‘ah.
- Your marriage remains intact, and living together is lawful.
5. Future Divorce Rights
- As one revocable divorce has been issued, you now have two divorces remaining in your Shari‘ah allowance.
6. Parents Forcing “Divorced” Declaration
- Your parents making you write “divorced” or the fact that your wife never received a divorce notice has no effect in Shari‘ah and does not change your marital status.
