Shar‘i Ruling on Using Sticks or Whips in Hudud Punishments

The Use of Sticks or Whips in Hudud Punishments: Shar‘i Guidance

Reference: Fatāwā Rashidiyyah, Page 514

❖ The Question

When implementing a ḥadd punishment, should a stick be used or the modern-day whip?

❖ The Answer

Al-ḥamdu lillāh, waṣ-ṣalātu wa-s-salāmu ‘alā Rasūlillāh, ammā ba‘d!

◈ At the time of the Prophet ﷺ and the Companions, branches from trees were generally used as whips.
◈ These were not the harsh, cruel modern-day lashes (chābak/whips).
◈ The harsh lashes invented today are purely oppressive in nature.
◈ Such lashes have no basis in Sharī‘ah.
