Question:

In online Quran academies, is it permissible to hire teachers on a monthly commission basis or under other conditional agreements regarding fees?

❖ Contractual Agreements and Their Shar‘i Validity​


If all terms are mutually agreed upon between the online Quran academy and the teacher, and both parties consent to these conditions, there is no Shar‘i objection to such an agreement.


❖ Important Considerations​


① Responsibility of the Academy:​


✔ The academy is responsible for finding students and connecting them with teachers.
✔ The academy is entitled to charge fees from students in return for these services.


② Responsibility of the Teacher:​


✔ Teachers are responsible for delivering lessons to students.
✔ They receive pre-agreed compensation for their teaching services.
✔ Teachers must be fully aware of the terms under which they are working.
✔ If they agree to these terms, the contract is Shar‘i valid.


❖ Permissibility of Monthly Commission System​


✔ If the academy monitors students and maintains the overall management of the system, it is justified in collecting monthly fees.
✔ There is no harm if the academy charges students a higher fee and then pays teachers according to their individual service agreements.


Clarity and Transparency in Agreement


✔ The contract between the academy and the teachers must be clear and transparent.
✔ This helps prevent misunderstandings or disputes.
✔ If the teacher is satisfied with the terms, the contract is Shar‘i valid.


❖ Summary​


A monthly fee- and condition-based agreement between online Quran academies and teachers is Shar‘i permissible if it is based on mutual consent and all terms are transparent and clearly defined.
