Taken from: Fatāwā ʿIlmiyyah, Vol. 1, Kitāb al-Ṣalāh, p. 259

❖ Question:

Our local scholar says:

“If a person regularly offers the five daily prayers in congregation but misses the first jamāʿah due to a valid excuse, he may conduct a second congregation. However, every latecomer may not establish a second jamā‘ah at will.”
When we request evidence, he simply says, “Ask a scholar.”
Please clarify the Shar‘i ruling regarding the second congregation in the mosque.

❖ Answer:

Praise be to Allah, and blessings and peace upon the Messenger of Allah ﷺ. To proceed:

✿ Conditions for the Permissibility of a Second Congregation

If someone has a valid Shar‘i excuse and could not attend the first jamā‘ah,
➋ Then it is permissible for him to organize a second congregation.

However:
➤ If a person intentionally delays or
➤ Establishes a second congregation out of rebellion, disunity, or with the intention of causing discord,
Then it is not permissible.

✿ Incorrect Practice of Conducting a Second Congregation

It is unlawful to form a second congregation in the mosque:

✔ Out of enmity toward the appointed Imām or mosque administration
✔ Or with the intention to divide the community

Those who do so should:

➤ Immediately strive for reconciliation
➤ And avoid introducing discord in the house of Allah

✔ Conclusion

❖ It is not permissible to establish a second jamā‘ah without a genuine excuse or merely due to lateness or disagreement.
❖ If someone missed the first jamā‘ah due to an unavoidable reason, then a second congregation is allowed.
❖ The practice should be governed by unity, humility, and respect for the mosque's order — not personal preference or division.
