Sharʿi Ruling on Divorce Uttered in Sleep

❀ Question:
If a person pronounces divorce while asleep, what is the ruling?
❀ Answer:
There is consensus among scholars that a divorce pronounced in the state of sleep is not valid, because a sleeping person is not legally accountable (mukallaf).
❀ Hafiz Ibn al-Mulaqqin (رح, d. 804H) said:
الإجماع على المجنون والنائم إذا تلفظا بصريح الطلاق لا يلزمهما
"There is consensus that if a madman or a sleeping person uses explicit words of divorce, it does not apply to them."
