Understanding Conditions in Buying and Selling Transactions
✍ Written by: Fatāwā Committee of Saudi Arabia
In commercial transactions, a condition (sharṭ) refers to one party binding the other to something that is not inherently required by the contract of sale itself.
The natural outcome of a sale contract is that:
① The item sold becomes the property of the buyer, and
② The price becomes the property of the seller.
Once the sale is finalized:
③ One party is obligated to pay the agreed amount, and
④ The other party is obligated to deliver the agreed item.
Any condition outside this basic framework is considered an added stipulation and must be examined in light of Sharīʿah principles.
