Sending Sacrificial Animals to the Ka‘bah Does Not Impose Ihram Restrictions

Hadith of ‘A’ishah (رضي الله عنها)


Sayyidah ‘A’ishah (رضي الله عنها) reported:


The Messenger of Allah ﷺ would send the sacrificial animal (hady) from Madinah (towards the Haram) and I would put garlands on them.
ثم لا يجتنب شيئا مما يجتنبه المحرم
“Then he ﷺ would not avoid anything that a person in ihram avoids.”

Explanation


These ahadith refute the opinion of Ahl al-Ra’y who claimed that if a person sends a sacrificial animal (hady) and places a garland (qala’id) on it, ihram automatically becomes obligatory upon him.


The correct view is as mentioned in the hadith — a person does not become a muhrim (one in ihram) merely by sending hady. Ihram is not binding until the person actually enters into it with the intention and the rites.
