Salary Ruling for Teachers Resigning Before New Academic Year

❀ Islamic Ruling on Payment of Salary During Vacation After a Teacher Resigns ❀


Question:

If a teacher intends to resign from an educational institution after completing the academic year, is the institution obligated to pay the salary for the two or two-and-a-half-month vacation period? Especially when the institution’s salary policy is based on the expectation that the teacher will continue teaching in the following year.


Answer by Fadhilat al-Shaykh ʿAbd al-Wakeel Nasir ḥafiẓahullāh:


➊ If the Teacher Decides to Resign at the End of the Academic Year:​


If the teacher settles all accounts at the end of the year and clearly informs the institution that he will not be continuing in the next academic session, the institution is not Islamically obligated to pay the vacation salary.
This is based on the fact that the teacher’s contract is typically tied to the commitment of teaching in the following year, and vacation salary is generally conditional upon this continued employment.


➋ If the Teacher Continues to Take Salary During the Vacation:​


If the teacher continues to receive salary during the vacation period without informing the institution of his decision not to teach in the next session, the institution will consider him to be under the obligation of teaching in the coming year.
If the teacher receives the vacation salary and then suddenly announces his resignation, this is irresponsible behavior, and it is more appropriate that the teacher should inform in advance.


➌ The Necessity of Advance Notice:​


It is incumbent upon the teacher to give advance notice if he intends to leave the institution so that the administration can make necessary arrangements.
To keep receiving salary without informing and then withdrawing from teaching responsibilities is an un-Islamic approach.


✔ Summary:​


◈ If a teacher clearly decides at the end of the academic year to resign, the institution is not obligated to pay the vacation salary.
◈ If the teacher continues to receive salary during vacation without notifying the administration and then suddenly resigns, this behavior is inappropriate, and advance notice is obligatory.
