Ruling on Wiping Over New Socks After Removing the Original Wiped Socks

Question:


What is the ruling if, after wiping over socks, a person removes them and wears another pair of socks — can he wipe over the new socks?


Answer:


Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, ammā baʿd!


Among the scholars, it is well-known that if a person performs ablution, wears socks, wipes over them, and then removes them to wear another pair of socks or stockings, the ruling is as follows:


View ① – Majority Opinion:


If wiping is done on one specific sock (whether the upper or lower layer), the Sharʿī ruling applies only to that sock. The ruling does not transfer to another sock.


View ② – Another Scholarly Opinion:


If wiping was done on the lower sock, and later another pair of socks or stockings is worn over it, and the wiping duration is still valid, then the ruling transfers to the upper socks/stockings.


Preferred (Rājiḥ) Opinion:


The correct and stronger view is that the ruling does transfer, provided that:
➊ Wiping was initially done on the lower socks.
➋ The upper socks/stockings were worn after that wiping.
➌ The prescribed duration for wiping has not yet expired.


Therefore:


If a person:
➊ Performs ablution.
➋ Wipes over his socks.
➌ Then wears another pair of socks/stockings over them.
➍ And later wipes over the upper socks/stockings.


Then — according to the stronger opinion — this is permissible, provided that:


  • The wiping duration is counted from the first wiping on the lower socks, not from the later wiping on the upper ones.
