Ruling on Taking Back Gifted Land – Sharʿi Clarification

❖ Question​


Respected scholars, it is presented that the wife of the late Khuda Bakhsh, namely Musammat Rahmat (sane and adult), gifted the remaining land to her father-in-law, Haji Musa, in the presence of witnesses, after receiving some cash money. This incident occurred approximately 35 years ago, and that land has since been divided among the heirs of Haji Musa.


Now, Musammat Rahmat wishes to reclaim that land. Kindly clarify whether she can take back the land she had gifted or not, according to Sharīʿah.


❖ Answer​


Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, ammā baʿd!


It should be clearly understood that Musammat Rahmat cannot reclaim the land that she had gifted (as a hiba), and such an act is impermissible.


◈ Evidences​


Hadith:
((عن ابن عباس قال قال رسول الله صلى الله عليه وسلم العائد فى هبته كالكلب يقيئى ثم يعود فى قيئه.))
(متفق عليه)


Translation:
Ibn ʿAbbās (RA) narrated that the Messenger of Allah ﷺ said:
“The one who takes back his gift is like a dog that vomits and then returns to its vomit.”


Hadith:
((عن ابن عمرو بن عباس رضى الله عنه عن رسول الله صلى الله عليه وسلم قال لا يحل للرجل أن يعطى العطية ثم يرجع فيها إلا الوالد فيما يعطى ولده.))
(رواه احمد)


Translation:
Ibn ʿAmr ibn ʿAbbās (RA) narrated that the Messenger of Allah ﷺ said:
“It is not lawful for a man to give a gift and then take it back, except a father regarding what he gives to his child.”


✅ Conclusion​


In light of the above aḥādīth, it is not permissible for Musammat Rahmat to reclaim the land she had gifted.
