Ruling on Sterilization and Birth Control Due to Medical Necessity

❀ Ruling on Birth Control Due to Medical Necessity ❀

Source:

This article is derived from the book 500 Questions and Answers for Women, based on the Fatwas of the scholars of the Haramain. The translation was done by Hafiz Abdullah Saleem.

❖ Question:

I am 27 years old and a patient of diabetes. During my last pregnancy, my condition deteriorated due to high blood sugar, and I had to start insulin injections. The baby was delivered through surgery. As a result, I underwent sterilization. Is this act permissible or forbidden? I should also mention that I am currently the mother of eight children. Jazakum Allahu Ahsan al-Jazā’.

❖ Answer:

Permanently preventing pregnancy or temporarily suspending it is impermissible unless there is a necessity.

The standard for determining necessity is when qualified doctors affirm that childbirth may:

✔ Aggravate a medical condition,
✔ Pose a threat to the mother’s life,
✔ Or lead to serious harm due to the pregnancy and delivery process.

Additionally, for permanent or temporary birth control, the husband’s consent is also required.

If the excuse no longer exists, then the woman should return to her previous natural state, i.e., she should not persist in preventing pregnancy.

Examples of valid necessities include:

✔ The woman’s illness,
Physical weakness,
✔ Inability to endure the pain of childbirth,
✔ Or inability to properly raise children due to overwhelming responsibility.
