Ruling on Taking Back Gifts After Engagement Is Broken
Question:

If an engagement is called off, is it permissible to take back the ring, clothes, or other gifts that were given during the engagement?

All such items are considered to be gifts (Hadiyyah) in Islamic law.
According to established Shar‘i principles, taking back a gift is not permissible.


✅ Conclusion:


Therefore, if an engagement ends, it is not permissible in Shari‘ah to take back the ring, clothes, or any other items that were given as gifts.
These remain the property of the recipient.


📚 Shar‘i Principle Referenced:​


  • Gifts (هدايا) cannot be reclaimed once given, as per the general ruling in authentic Hadith unless under very specific exceptions (such as a father giving to a child).
