Ruling on Passing the Miqat Without Ihram When Intending to Perform Umrah

❖ Question​


What is the ruling regarding a person who intends to perform Umrah but passes the Miqat without entering into the state of Ihram?


❖ Answer​


Alḥamdulillāh, waṣ-ṣalātu was-salāmu ‘alā Rasūlillāh, ʾAmma ba‘d!


If a person intends to perform Hajj or Umrah, it is obligatory for him not to pass the Miqat without entering the state of Ihram, because the Noble Prophet ﷺ said:


«يُهِلُّ اَهْلُ الْمَدِيْنَةِ مِنْ ذِی الْحُلَيْفَةِ…»
"The people of Madinah should enter into Ihram from Dhul-Hulaifah."
(Ṣaḥīḥ al-Bukhārī, Kitāb al-Ḥajj, Chapter: The Miqat of the People of Madinah, Ḥadīth: 1525)



❖ Explanation of Rulings​


It is obligatory for anyone intending to perform Hajj or Umrah to enter into Ihram from the Miqat.
It is not permissible to pass the Miqat without entering into Ihram.


❖ What if someone passes the Miqat without entering into Ihram?​


① First Scenario:​


If the person returns to the Miqat after passing it and enters into Ihram from there:


Then no compensation (fidya) is required.


② Second Scenario:​


If the person does not return to the Miqat and instead enters into Ihram from his current location:


✿ Then, according to the scholars, fidya becomes obligatory upon him.


✿ The fidya includes the following:


He must slaughter an animal,
And distribute its meat among the poor in Makkah.
