Ruling on Marrying an Open Sinner in Islam – Is It Valid?

Source: Fatāwā Amunpuri by Shaykh Ghulam Mustafa Zaheer Amunpuri

❖ Question:

Is it permissible to marry someone who openly commits sins (i.e., an open sinner/fāsiq)?

✿ Answer:

If someone marries a person who openly commits sins, then Islamically, the marriage will be considered valid, provided all the conditions of Nikah are fulfilled.

❀ Evidence from the Qur’an:

اللَّهُ تَعَالَى فَرْمَاتَے ہَیں:

﴿الْخَبِيثَاتُ لِلْخَبِيثِينَ وَالْخَبِيثُونَ لِلْخَبِيثَاتِ﴾

📖 Surah An-Nūr: 26
“Impure women are for impure men, and impure men are for impure women.”

✅ Summary:

✔ A marriage with an openly sinful person is valid under Islamic law if the conditions of Nikah are fulfilled.
✔ However, based on the verse, it is indicated that pure individuals are matched with the pure, and impure with the impure — suggesting the moral implications of such a marriage, even though the contract remains valid.
