Ruling on Hajj of a Non-Praying Person and Missed Worship After Tawbah

❖ Ruling on Hajj of a Non-Practicing Muslim and Making Up Missed Acts of Worship After Repentance ❖

Question:


If a person performs Hajj while neither offering prayers nor fasting, what is the Islamic ruling on such a person's Hajj? And if he repents, is he obligated to make up for the acts of worship he previously abandoned?


Answer:


الحمد لله، والصلاة والسلام علىٰ رسول الله، أما بعد!


Ruling on the One Who Abandons Prayer:


Abandoning Salah is an act of disbelief (Kufr).
◈ Such a person is considered to have exited the fold of Islam, and he becomes deserving of eternal punishment in Hell.
◈ This ruling is established by the Qur'an, the Sunnah, and the statements of the righteous predecessors (Salaf al-Salihīn).


Entry to Makkah is Forbidden for Such a Person:


Due to this, a person who does not pray is not permitted to enter Makkah, based on the statement of Allah ﷻ:


﴿يـأَيُّهَا الَّذينَ ءامَنوا إِنَّمَا المُشرِكونَ نَجَسٌ فَلا يَقرَبُوا المَسجِدَ الحَرامَ بَعدَ عامِهِم هـذا﴾
(Surah At-Tawbah, 9:28)
"O you who believe! Indeed, the polytheists are impure, so let them not approach al-Masjid al-Haram after this year."


❖ Hajj of the One Who Does Not Pray:​


The Hajj of a person who does not perform Salah is not accepted.
◈ Such a Hajj is considered the Hajj of a disbeliever, and the acts of worship of a disbeliever are not accepted.
◈ Allah ﷻ says:


﴿وَما مَنَعَهُم أَن تُقبَلَ مِنهُم نَفَقـتُهُم إِلّا أَنَّهُم كَفَروا بِاللَّهِ وَبِرَسولِهِ وَلا يَأتونَ الصَّلوةَ إِلّا وَهُم كُسالى وَلا يُنفِقونَ إِلّا وَهُم كـرِهونَ﴾
(Surah At-Tawbah, 9:54)
"And nothing prevents their expenditures from being accepted except that they disbelieved in Allah and His Messenger, and they do not come to prayer except while they are lazy, and they do not spend except while they are unwilling."


❖ Making Up Missed Worship After Repentance:​


◈ If such a person repents sincerely, then he is not obligated to make up for the acts of worship (like Salah and Sawm) that he had abandoned in the past.
◈ Allah ﷻ states:


﴿قُل لِلَّذينَ كَفَروا إِن يَنتَهوا يُغفَر لَهُم ما قَد سَلَفَ﴾
(Surah Al-Anfāl, 8:38)
"Say to those who have disbelieved that if they cease (from disbelief), their past will be forgiven."


❖ The Method of Repentance and Allah’s Mercy:​


◈ Whoever has abandoned Salah or other acts of worship must make sincere repentance before Allah ﷻ.
◈ He must then adhere to the obedience of Allah and engage in righteous deeds.
◈ He should do abundant good deeds, make frequent repentance and seek forgiveness, so that he may attain nearness to Allah.
◈ Allah ﷻ says:


﴿قُل يـعِبادِىَ الَّذينَ أَسرَفوا عَلى أَنفُسِهِم لا تَقنَطوا مِن رَحمَةِ اللَّهِ إِنَّ اللَّهَ يَغفِرُ الذُّنوبَ جَميعًا إِنَّهُ هُوَ الغَفورُ الرَّحيمُ﴾
(Surah Az-Zumar, 39:53)
"Say: O My servants who have transgressed against themselves [by sinning], do not despair of the mercy of Allah. Indeed, Allah forgives all sins. Truly, He is the Most Forgiving, the Most Merciful."


◈ This blessed verse was revealed concerning those who repent.
Any sin — even shirk — is forgiven if the person repents sincerely to Allah ﷻ.
