Can a girls’ madrasa be established on the upper floor of a mosque, while Friday prayer is also performed on that floor?
الحمد لله، والصلاة والسلام علىٰ رسول الله، أما بعد!
◄ The upper floor of a mosque is also included in the ruling of the mosque.
◄ Just as it is not permissible to establish a girls’ madrasa on the lower or first floor of the mosque, it is likewise not permissible to establish a girls’ madrasa on the upper floor.
It is narrated:
وصلى أبو هريرة على ظهر المسجد بصلاة الإمام
(Reported by Ibn Abī Shaybah and Saʿīd ibn Manṣūr, mentioned by al-Bukhārī in taʿlīq form – Ṣaḥīḥ al-Bukhārī, Bāb al-Ṣalāh fī al-Ṭawḥ wa-l-Mutabar, vol. 1, pp. 54–55)
“Abū Hurayrah (رضي الله عنه) prayed on the roof of the mosque, following the prayer of the Imām while the Imām was leading in the lower floor.”
This shows that the upper floor of the mosque is still considered part of the mosque. Therefore, using it for a girls’ madrasa is not permissible.
ھذا ما عندي والله أعلم بالصواب
