Entering Makkah Without Iḥrām to Perform Hajj: Ruling and Expiation

❖ Question:​


If a person enters Makkah without wearing Iḥrām, intending to deceive the authorities into thinking he does not intend to perform Hajj, but later puts on Iḥrām from within Makkah — will his Hajj be valid?


❖ Answer:​


Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, ammā baʿd...


In this case:


The Hajj itself will be valid.
✖ However, the person’s action will be considered prohibited for two reasons:


❖ ① Crossing the Mīqāt Without Iḥrām​


✿ He violated the sacred boundary set by Allah ﷻ by passing the mīqāt without assuming Iḥrām.
✿ This is a Shar‘i transgression, as Allah has designated specific locations (mīqāt) from which it is obligatory to enter into Iḥrām for Hajj or ʿUmrah.


❖ ② Disobedience to the Rulers​


✿ He disobeyed the lawful commands of the authorities whom obedience is obligatory upon — as long as their rules do not contradict Sharīʿah.
✿ In this case, he intentionally violated the law set by the authorities regarding entry into Makkah for Hajj or ʿUmrah.


❖ What Is Required From Such a Person?​


❶ He must repent and seek forgiveness from Allah ﷻ, as this act falls under sinful behavior.


❷ He must offer expiation (fidya) by slaughtering one animal, and distributing its meat among the poor of Makkah.


❸ This is because he abandoned a wajib (obligation) — namely, entering into Iḥrām from the prescribed mīqāt.


As the scholars state:


"Whoever neglects a wajib of Hajj or ʿUmrah must offer a fidya."
