This is an invalid act, as the wealth of the deceased is a right of the heirs in accordance with the distribution ordained by Allah ﷻ. It is impermissible to deprive them of this right without their consent and satisfaction.
The Prophetic saying is:
"It is not permissible to take the wealth of a Muslim except with his good pleasure."
[Musnad Ahmad 113/5; Sahih al-Jamiʿ, Hadith number 7662]
Such an endowment (waqf) is invalid and impermissible, as it is a form of oppression and falls under the category of consuming people’s wealth unjustly.
