The Ruling on Blood Money and Compensation for a Slave
Written by: Imran Ayub Lahori
❖ Ruling:
The blood money (diyah) for a slave is the payment of his market value, and compensation for his injuries is also calculated according to his value.
On this issue, no marfu‘ narration from the Prophet (ﷺ) is found, but the matter is established among the scholars without any difference of opinion.
❖ Point of Disagreement:
The only difference arises when the value of the slave exceeds the diyah of a free person:
- If the slave’s price is more than the diyah of a free person, is the higher amount to be paid?
The stronger opinion (راجح) is that the full value of the slave must be paid, even if it exceeds the diyah of a free person.
