Ruling on a Man Forcing His Wife to Intercourse During Fasting

❖ Question:​

What is the ruling when a man forces his wife to have intercourse during the day in Ramadan? It should be noted that neither the husband nor wife is capable of freeing a slave, and due to being engaged in earning a livelihood, they are unable to fast continuously. In such a case, is it sufficient to only feed the poor? And what is the quantity and type of the food to be given?

❖ Answer:​

If a man compels his wife to intercourse during a day in Ramadan, and both spouses are fasting, then the ruling is as follows:

✔ The wife’s fast remains valid, and no expiation (kaffārah) is required from her, because the act was done under compulsion.

✖ However, the man is liable and must offer expiation for violating the sanctity of Ramadan through intercourse. The sequence of kaffārah is:

Freeing a slave
② If unable to do so, then fasting two consecutive months
③ If unable to do that either, then feeding sixty poor people

This is based on the authentic Hadith of Abū Hurayrah رضي الله عنه reported in Ṣaḥīḥ al-Bukhārī and Ṣaḥīḥ Muslim.

Additionally, he is also required to make up (qaḍāʾ) for the fast he broke.
