In the case of divorce, neither of the parents should prevent the other from meeting the child.
When the wife leaves the marital home or when separation occurs between the husband and wife due to divorce or other reasons, and they have one or more children, Islamic law does not provide any justification for preventing a parent from seeing or meeting their child. If the child is under the care of the mother, it is impermissible for her to prevent the father from meeting or seeing the child. This is because Allah has made maintaining family ties obligatory:
"And worship Allah and do not associate anything with Him, and do good to parents and relatives."
[Surah An-Nisa: 36]
Furthermore, the Hadith states:
“Whoever separates a mother from her child, Allah will separate him from his loved ones on the Day of Judgment.”
[Sunan at-Tirmidhi, Hadith No. 1566]
The Permanent Committee for Islamic Research and Fatwa (Fatwa No. 21102) also emphasizes this principle.
