Permissibility of Non-Intercourse Intimacy Before Istibra’ in Light of Ibn ʿUmar’s Practice

Enjoyment Other Than Intercourse Permissible Before Istibra’

The prohibition before istibra’ (waiting period to ensure the womb is free) applies only to intercourse, not to other forms of lawful enjoyment.


This is supported by the action of ʿAbdullah ibn ʿUmar (RA):


He said that on the day of Jalulaʾ, a female slave came into his share who had a neck like a silver jug. I could not restrain myself, so I began kissing and embracing her while people were watching.

Implication:
While intercourse must be avoided until the completion of istibra’, other forms of permissible intimacy such as kissing and embracing are allowed, as demonstrated by the practice of Ibn ʿUmar (RA).
