Right to Declare the Price – Owner Has Priority​

❖ Question:​


Who has more right to declare the price of an item — the seller or the buyer?


❖ Answer:​


The seller (owner) has more right to declare the price, because the item belongs to him.


Scholarly Statements​


ʿAllāmah Ibn Baṭṭāl (رحمه الله, d. 449H) said:


لا خلاف بين الأمة أن صاحب السلعة أحق الناس بالسوم فى سلعته، وأولى بطلب الثمن فيها .


“There is no difference of opinion in the Ummah that the owner of the goods is the most entitled to set the price of his goods and to demand its value.”
(Sharḥ Ṣaḥīḥ al-Bukhārī: 6/235)


❀ This was also the fatwā of Imām Aḥmad ibn Ḥanbal (رحمه الله).

✅ Conclusion:
The right to declare and demand the price of an item belongs first and foremost to its owner, as it is his property.
