Nikah of a Married Woman: Ruling on the One Who Performs It

❖ Question:​


What is the ruling on a person who conducts the nikāḥ of a married woman with another man?


✿ Answer:​


➤ If the individual did not know that the woman was already married, then he is not sinful.


➤ However, if he knew that the woman was married and still proceeded to conduct her nikāḥ with another man, then he is severely sinful.


✦ Qur’anic Evidence:​


وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ
📖 [Sūrah al-Mā’idah: 2]


Translation:

“And do not cooperate in sin and transgression.”


✅ Summary:​


➤ Conducting a nikāḥ for a woman who is already married is a grave sin if done knowingly.
➤ Such an act is assisting in sin and injustice, which the Qur’ān explicitly prohibits.
➤ If done unknowingly, there is no blame upon the one conducting the marriage.
