❖ Nikāḥ Should Be Announced, Not Kept Hidden

It is narrated from ʿAbdullāh ibn al-Zubayr رضي الله عنه that the Messenger of Allāh ﷺ said:
"أعلنوا النكاح"
“Announce the marriage.”
Grading: Ḥasan – Ādāb al-Zifāf, p. 183
This narration establishes that nikāḥ should not be kept secret; rather, public announcement is required.
A case of secret nikāḥ was brought before ʿUmar ibn al-Khaṭṭāb رضي الله عنه in which only one man and one woman were witnesses. He said:
"هذا نكاح السر ولا أجيزه، ولو كنت تقدمت فيه لرَجمت."
“This is a secret marriage. I do not approve of it. If I had authority over it, I would have stoned (them).”

This ruling highlights the strict disapproval of secret marriages even from the senior Companions.
The Qur’ān states:
"فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ"
“So do not prevent them from marrying their (former) husbands.”
Sūrat al-Baqarah: 232
This verse shows that if a guardian (walī) unjustly prevents a woman from marrying, the obstruction is removed.
Example: The Prophet ﷺ married Umm Ḥabībah رضي الله عنها without her guardian, as her wali at the time was a non-Muslim.

❖ Even in such cases, the woman cannot perform the nikāḥ independently; instead, the ruler (ḥākim) acts as her guardian, just as Najāshī did in the marriage of Umm Ḥabībah رضي الله عنها.
Either party—the groom or the bride—may appoint a wakīl (representative) to conduct the nikāḥ, and both may even appoint the same individual.
Narrated by ʿUqbah ibn ʿĀmir رضي الله عنه:
The Prophet ﷺ said to a man:
“Would you like me to marry you to so-and-so woman?”
He replied, “Yes.”
Then the Prophet ﷺ asked the woman:
“Would you like me to marry you to so-and-so man?”
She said, “Yes.”
So the Prophet ﷺ performed their nikāḥ.

➤ Permissibility of a single representative (wakīl) conducting the marriage is supported by:
✘ Imām al-Shāfiʿī رحمه الله did not permit this arrangement.

The first view is stronger, due to the clear authentic narration supporting it.
✔ Nikāḥ must be publicly announced to distinguish it from secretive and unlawful relationships.
✔ A valid nikāḥ requires proper announcement, guardian (or authority), and witnesses.
✔ If the guardian is unjustly withholding or is a non-Muslim, the ruler or judge acts as wali.
✔ Appointment of a wakīl by either or both parties is permissible in light of Sunnah.

❖ ➊ Command of the Prophet ﷺ to Publicize the Nikāḥ
It is narrated from ʿAbdullāh ibn al-Zubayr رضي الله عنه that the Messenger of Allāh ﷺ said:

❖ ➋ ʿUmar ibn al-Khaṭṭāb’s Verdict on Secret Nikāḥ

❖ ➌ Exceptions: When the Walī is Absent or a Non-Muslim
The Qur’ān states:

❖ Scholarly Opinions
➤ Permissibility of a single representative (wakīl) conducting the marriage is supported by:
- Imām Mālik رحمه الله
- Imām Abū Ḥanīfah رحمه الله
- Imām Awzāʿī, Imām Rabīʿah, Imām Thawrī, Imām Layth, Imām Abū Thawr, and others
✘ Imām al-Shāfiʿī رحمه الله did not permit this arrangement.
Preferred (Rājiḥ) Opinion:
The first view is stronger, due to the clear authentic narration supporting it.
❖ Conclusion:
✔ Nikāḥ must be publicly announced to distinguish it from secretive and unlawful relationships.
✔ A valid nikāḥ requires proper announcement, guardian (or authority), and witnesses.
✔ If the guardian is unjustly withholding or is a non-Muslim, the ruler or judge acts as wali.
✔ Appointment of a wakīl by either or both parties is permissible in light of Sunnah.
