❖ Nikāḥ Is Not Valid Without Two Just Witnesses​

❖ ➊ Prophetic Declaration on Witnesses and Guardian​


It is narrated from ʿImrān ibn Ḥuṣayn رضي الله عنه that the Messenger of Allāh ﷺ said:


"لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَشَاهِدَي عَدْلٍ"
“There is no marriage without a guardian and two just witnesses.”

❖ ➋ Testimony Must Be From Just Witnesses​


In the narration from ʿĀʾishah رضي الله عنها, the words used are:


"وَشَاهِدَي عَدْلٍ"
“Two trustworthy (just) witnesses”

❖ ➌ Statement of ʿAbdullāh ibn ʿAbbās رضي الله عنهما​


He said:


"لَا نِكَاحَ إِلَّا بِشَاهِدَي عَدْلٍ وَوَلِيٍّ مُرْشِدٍ"
“There is no nikāḥ except with two just witnesses and a wise guardian.”

❖ ➍ Condemnation of Secret Marriage Without Witnesses​


Another narration from Ibn ʿAbbās رضي الله عنهما reports that the Prophet ﷺ said:


"البغايا اللاتي ينكحن أنفسهن بغير بيّنة"
“The immoral women are those who marry themselves off without witnesses.”

Though this narration is weak, the collective weight of other authentic reports makes the ruling clear.


❖ Scholarly Consensus and Views​


Imām al-Tirmidhī رحمه الله stated:


“The scholars among the Companions and the Tābiʿīn held the view that nikāḥ is not valid without witnesses.”

❖ Juristic Opinions​


Imām al-Shāfiʿī رحمه الله


  • Marriage is invalid without male witnesses
  • Justice (ʿadālah) of witnesses is required

Imām Abū Ḥanīfah, Imām Aḥmad رحمهما الله


  • One man and two women are sufficient
  • ʿAdālah is not a condition according to Ḥanafīs

Imām Mālik رحمه الله


  • Mere announcement of marriage is sufficient even without formal testimony

✅ Preferred (Rājiḥ) Opinion:​


The opinion of Imām al-Shāfiʿī رحمه الله is the strongest and most supported:


✔ A nikāḥ is not valid without:


  • A guardian (walī)
  • Two upright (ʿadl) male witnesses

❖ Conclusion:​


❖ Islam does not recognize private or secret marriages
❖ A valid nikāḥ requires:


  • Public announcement
  • Guardian (walī)
  • Two trustworthy male witnesses
    ❖ This prevents confusion, deception, and protects the dignity of marriage

وَاللهُ أَعْلَمُ بِالصَّوَابِ
And Allāh knows best what is correct.
