Maintenance During Iddah After Husband’s Death in Islam

Question

Is a woman entitled to maintenance (nafaqah) during the waiting period (ʿiddah) after the death of her husband?

Answer

If a woman observing the ʿiddah due to the death of her husband is pregnant, then she is entitled to maintenance, and this maintenance will be paid from the deceased husband’s estate. If the woman is not pregnant, then no one is responsible for her maintenance.

Allah Almighty says:

(At-Ṭalāq: 6)

“And if they are pregnant, then spend on them until they deliver their burden.”

❀ When Sayyidah Fāṭimah bint Qays رضي الله عنها was given three divorces, the Prophet ﷺ said:

“There is no maintenance for you unless you are pregnant.”
