Rulings on Lost Property (Luqatah) in Islam

◈ Definition of Luqatah
- Luqatah: A lost item found on the way whose owner is unknown.
- Linguistic root:
- al-Taqata (افتعال) and Laqata (نصر) → “to pick up from the ground.”
- al-Luqat and al-Laqit → “that which is picked up.”

The word appears in the Qur’an:
فَالْتَقَطَهُ آلُ فِرْعَوْنَ [القصص: 8]
“Then the people of Pharaoh picked him up.”
◈ Its Legitimacy
① Allah says:
وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَىٰ [المائدة: 2]
“Cooperate with one another in righteousness and piety.”
② The Prophet ﷺ said:
والله فى عون العبد ما كان العبد فى عون أخيه
“Allah remains in the help of His servant so long as the servant is in the help of his brother.”
[Muslim: 2699]
◈ Basic Ruling
Whoever finds lost property must:
- Announce its container and strap.
- If the owner appears, return it to him.
- If the owner does not appear, it becomes Allah’s wealth which He gives to whom He wills.

◈ Detailed Rulings
① Lost Gold and Silver
Zayd bin Khalid (RA) narrated that the Prophet ﷺ said:
- Announce it for one year.
- If no owner is found, you may use it, but keep it as a trust.
- If the owner ever comes, return it.
For a lost camel: leave it — it will find water and food until its owner finds it.
For a goat: take it, for it is either for you, your brother, or the wolf.

② Lost Property With Clear Signs
Ubayy bin Ka‘b (RA):
“Announce it. If someone describes its duration, container, and strap correctly, give it to him; otherwise use it.”
[Bukhari: 2437; Muslim: 1723]
This proves that one who correctly identifies its marks deserves it, even without further proof.

③ Duration of Announcement
- General view (Jumhur): One year is enough.
- Hadith of Ubayy (RA): The Prophet ﷺ instructed him to announce for up to three years regarding 100 dinars.

Scholars differed:
- Ibn Hazm (رحمه الله): Anything beyond one year is incorrect.
- Ibn al-Jawzi (رحمه الله): A mistake from the narrator; only one year is correct.
- al-Mundhiri (رحمه الله): No Imam gave fatwa of three years.
- Some reconciled: More than one year is not obligatory, but shows greater piety.

④ Can the Wealthy Use Luqatah?
- Jumhur: After due announcement, both rich and poor may use it, as the evidences are general.

⑤ Special Case of Makkah
Abu Hurairah (RA): The Prophet ﷺ said:
أنها لا تحل لقطة مكه إلا لمعرف
“The luqatah of Makkah is not permissible except for one who announces it.”
[Bukhari: 2434; Muslim: 1355]
- Jumhur: In Makkah, it must always be announced.
- Hanafis: Same ruling as anywhere else.
- Rajih view: Jumhur, as supported by explicit Hadith.
⑥ Small and Trivial Items
- For things like sticks, whips, ropes — announce three times, then use.
[Ahmad: 4/173; ‘Abd al-Razzaq: 10/142] - For eatables: they may be consumed without announcement.
Hadith of Anas (RA): The Prophet ﷺ saw a date and said:
لولا أني أخاف أن تكون من الصدقة لأكلتها
“If I did not fear it might be from charity, I would have eaten it.”
[Bukhari: 2431; Muslim: 1071]
⑦ Animals
- Camels: Do not take them.
- Sheep & similar animals: Permissible to take (otherwise, wolf will eat).
[Bukhari: 2428] - Any lost property must be announced; otherwise, one is sinful.
[Muslim: 1725]
✔ Nawab Siddiq Hasan Khan (رحمه الله): Other animals similar to goats (weak and vulnerable) fall under the same ruling.

◈ Summary
- Luqatah must be announced for one year, unless trivial.
- Owner’s correct description makes him rightful owner.
- If unclaimed, finder may use it but remains liable to return it if the owner comes.
- Makkah’s luqatah: Must always be announced.
- Trivial items: Announce three times, then permissible.
- Food: May be consumed if not suspected of being charity.
- Camels: Do not take; sheep and weaker animals: permissible.
