Ruling on Marriage After Triple Ṭalāq by a Ḥanafī Husband: Perspective of Ahl al-Ḥadīth

If a man, following the Ḥanafī school, gives his wife three divorces in one sitting (which is the ṭalāq bidʿī method), can an Ahl al-Ḥadīth man marry that woman? Since, according to Ahl al-Ḥadīth, three divorces in one sitting count only as a single divorce, what is the ruling in such a case?
Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, Ammā Baʿd!
You have rightly mentioned that:
❀ Three divorces in one sitting count as only one ṭalāq according to Sharīʿah.
❀ In such a situation, the husband has the right to take his wife back during her ʿiddah, without requiring a new nikāḥ.
Allah ﷻ says:
﴿وَبُعُولَتُهُنَّ أَحَقُّ بِرَدِّهِنَّ فِي ذَٰلِكَ إِنۡ أَرَادُوٓاْ إِصۡلَٰحٗاۚ﴾
“And their husbands have the better right to take them back during that period, if they desire reconciliation.”
(Sūrah al-Baqarah: 228)
❀ If the ʿiddah finishes and the husband does not take her back, then the woman and man may enter into a new nikāḥ with mutual consent.
Allah ﷻ says:
“And when you divorce women and they have fulfilled their term, do not prevent them from remarrying their [former] husbands if they agree among themselves in a lawful manner.”
(Sūrah al-Baqarah: 232)
Sharīʿah is one and the same for all Muslims—whether Ahl al-Ḥadīth, Ḥanafī, or followers of any other school. There are not multiple separate systems of Islamic law.

Question:
If a man, following the Ḥanafī school, gives his wife three divorces in one sitting (which is the ṭalāq bidʿī method), can an Ahl al-Ḥadīth man marry that woman? Since, according to Ahl al-Ḥadīth, three divorces in one sitting count only as a single divorce, what is the ruling in such a case?
Answer:
◈ After Completion of ʿIddah:
❀ If the ʿiddah finishes and the husband does not take her back, then the woman and man may enter into a new nikāḥ with mutual consent.
Allah ﷻ says:
“And when you divorce women and they have fulfilled their term, do not prevent them from remarrying their [former] husbands if they agree among themselves in a lawful manner.”
(Sūrah al-Baqarah: 232)
◈ Clarification of the Issue:
- If a Ḥanafī man gives his wife three divorces in one sitting, then according to Ahl al-Ḥadīth, this counts as one ṭalāq.
- If the woman and her first husband agree during her ʿiddah, reconciliation is possible and their marriage bond remains intact.
- If the ʿiddah has ended and she chooses not to return to her first husband, then it is permissible for her to marry an Ahl al-Ḥadīth man with mutual consent.
⚖ Important Principle:
Sharīʿah is one and the same for all Muslims—whether Ahl al-Ḥadīth, Ḥanafī, or followers of any other school. There are not multiple separate systems of Islamic law.
