Islamic Ruling on Taking Jizyah from the Magians (Majūs)

Question:​


Is jizyah (tax) to be taken from the Magians (Zoroastrians)?

Answer:​


Yes, jizyah is to be collected from the Magians (Majūs) who reside in an Islamic state. In return, their lives and wealth are granted protection.

Scholarly Consensus:​


ʿAllāmah Ibn Qudāmah رحمه الله (620 AH):


إن أخذ الجزية من أهل الكتابين والمجوس ثابت بالإجماع، لا نعلم فيه خلافا، فإن الصحابة رضي الله عنهم أجمعوا على ذلك، وعمل به الخلفاء الراشدون، ومن بعدهم إلى زمننا هذا، من غير نكير ولا مخالف، وبه يقول أهل العلم من أهل الحجاز والعراق والشام ومصر وغيرهم، مع دلالة الكتاب على أخذ الجزية من أهل الكتاب، ودلالة السنة على أخذ الجزية من المجوس
“Taking jizyah from the People of the Book and the Magians is established by consensus. We know of no disagreement in this. The Companions رضي الله عنهم unanimously agreed upon it, and the Rightly Guided Caliphs practiced it, as did the generations after them until our time, without objection or opposition. The scholars of Ḥijāz, ʿIrāq, Shām, Egypt, and others all affirm this. The Qur’an indicates the taking of jizyah from the People of the Book, while the Sunnah indicates the taking of jizyah from the Magians.”

  • Jizyah is taken from the Magians just as it is from the People of the Book.
