❖ Ruling on Remarrying the Former Husband After Khulʿ ❖

Can a woman remarry her former husband after obtaining Khulʿ from him?
الحمد لله، والصلاة والسلام علىٰ رسول الله، أما بعد!
In a case where a woman has taken Khulʿ from her husband, she is permitted to remarry her former husband.
Imām al-Shāfiʿī رحمه الله has presented the following narration regarding this issue:
"سفيان عن عمرو بن دينار عن طاوس قال سأل إبراهيم بن سعد ابن عباس رضي الله عنهما عن رجل طلق امرأته تطليقتين ثم اختلعت منه أيتزوجها؟"
Translation: “A man divorced his wife with two divorces, then she obtained Khulʿ from him. Ibrāhīm ibn Saʿd asked Ibn ʿAbbās رضي الله عنهما about this, and he replied: ‘If he wishes, he may marry her again.’”

This narration is authentically reported (Sanad Ṣaḥīḥ).
If Imām al-Shāfiʿī رحمه الله received this narration from Sufyān ibn ʿUyaynah رحمه الله, then it is understood to be a direct transmission (Samāʿ).

From this narration, it is evident that ʿAbdullāh ibn ʿAbbās رضي الله عنهما considered Khulʿ to be a form of annulment (فسخ) of the marriage contract.
On this basis, he permitted remarriage between the two.
So even if the husband had given only one ṭalāq (وطلقها تطليقة) prior to the Khulʿ, it would still be regarded as an annulment.
Thus, the woman may remarry the same husband.
① Thiqah Tābiʿī Maymūn ibn Mihrān رحمه الله said:
"يتزوجها ويسمي لها مهرا جديدا"
“He may marry her again and must specify a new dowry (Mahr).”

② Imām Ibn Shihāb al-Zuhrī رحمه الله stated:
“He should not marry her for less than the amount he had given her in Khulʿ.”

هٰذا ما عندي والله أعلم بالصواب

Can a woman remarry her former husband after obtaining Khulʿ from him?
