❀ Marriage of a Pregnant Woman: Islamic Ruling, Role of Nikah Khwan and Witnesses ❀


❖ Question Clarification​


A woman who is pregnant has her nikah performed. At this event, the following individuals are involved:


Nikah Khwan (the one officiating the marriage)
Witnesses (those testifying to the nikah)
Groom (to whom she is being married)
Other attendees (who are in some way associated with the nikah)


Two different situations are possible:


➊ Some or all of these individuals know, or are unaware, that the woman is pregnant.
➋ The Nikah Khwan is unaware, or this fact is deliberately hidden from him.


❖ Answer​


Alḥamdulillāh, waṣ-ṣalātu wa-salāmu ʿalā Rasūlillāh, ammā baʿd!


This nikah is Islamically invalid and considered a crime.


Its basis is the command of Allah ﷻ:


﴿وَأُوْلَٰتُ ٱلۡأَحۡمَالِ أَجَلُهُنَّ أَن يَضَعۡنَ حَمۡلَهُنَّۚ﴾
(Al-Ṭalāq: 4)
"And the waiting period of pregnant women is until they deliver their burden (i.e., give birth)."



This verse clearly establishes that the ʿiddah of a pregnant woman ends only when she gives birth.
Therefore, marrying during this period is not permissible.


❖ Accountability of Those Involved​


If the attendees were aware that the woman was pregnant, then their guilt is clear.
If they were unaware, their sin is comparatively lighter, but they are still counted among the guilty.


❖ Position of the Nikah Khwan​


◈ If the Nikah Khwan did not know that the woman was pregnant, or if this fact was deliberately hidden from him, he still became a part of an unlawful act.
◈ Lack of knowledge may reduce the severity of sin, but it does not absolve him completely.


❖ Punishment and Taʿzīr​


◈ There is no fixed ḥadd (legal punishment) in the Qur’an and Sunnah for this act, but since it is a crime, it falls under taʿzīr (discretionary punishment).
◈ The Messenger of Allah ﷺ said:


«لاَ يُجْلَدُ فَوْقَ عَشْرِ جَلَدَاتٍ إِلاَّ فِیْ حَدٍّ مِنْ حُدُوْدِ اﷲِ»
(Bukhārī, Kitāb al-Ḥudūd, Bāb: Kam al-Taʿzīr wal-Adab)
"One should not be lashed more than ten lashes except in one of the prescribed punishments of Allah."



Hence, in this matter, the taʿzīr would be left to the discretion of the judge, but it cannot exceed ten lashes.


❖ Necessary Steps​


◈ All those involved must repent sincerely.
◈ The nikah must be annulled immediately, as Islamically it is invalid.
◈ Immediate separation between the man and woman is obligatory.
