Reference: Fatāwā Rashidiyyah, Page 514
❖ The Question
Explain, in the light of the Qur’an and Hadith, whether martial law is correct.
❖ The Answer
Al-ḥamdu lillāh, waṣ-ṣalātu wa-s-salāmu ‘alā Rasūlillāh, ammā ba‘d!
◄ In the fundamental sources of Islam — the Qur’an and Hadith — there is no word or concept equivalent to “martial law.”
◄ In Islam, there is no scope for such oppressive and tyrannical laws.
◄ Martial law is in fact an invention of authoritarian rulers, which stands completely opposed to the principles of justice and fairness.
◄ This un-Islamic concept is the result of blind imitation of the British, and it is incorrect to associate it with Islam.
