✿ Buying and Selling of Water



This matter involves detail:

① If a person collects water in a container or reservoir, he becomes its owner, and it is permissible for him to sell it, because he has gathered and taken possession of it, enduring effort in doing so. Therefore, it enters into his ownership.


② However, if the water remains in a well, canal, or any flowing watercourse that runs through his property, then among the scholars there is a difference of opinion.

③ The correct view is that it is not permissible for him to sell such water. Nonetheless, compared to others, he has a stronger right to benefit from it, though he cannot prevent others from utilizing it in a manner that does not cause harm, because the Prophet ﷺ forbade the selling of water beyond one's need.
