Inheritance Distribution: Two Sons and Four Daughters​

❖ Question​


What do the esteemed scholars say regarding this case:


Muhammad Urs passed away, leaving behind:
◄ Two sons (Muhammad and Muhammad Husain)
◄ Four daughters


According to the Shariah of Muhammad ﷺ, how should the estate be divided among them?


❖ Answer​


Al-ḥamdu lillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, ammā baʿd!


It must be remembered that before distribution of the inheritance, the estate is subject to the following:


➊ Expenses for shrouding and burial are deducted.
➋ Any debts of the deceased are paid.
➌ A valid bequest is fulfilled, but only up to one-third (⅓) of the estate.


The remaining estate is then the actual inheritance to be distributed.


Classical Distribution (Based on 1 Rupee Estate)​


◄ Son Muhammad → 4 annas
◄ Son Muhammad Husain → 4 annas
◄ Daughter → 2 annas
◄ Daughter → 2 annas
◄ Daughter → 2 annas
◄ Daughter → 2 annas


Qur’anic Principle​


Allah ﷻ says:
﴿لِلذَّكَرِ‌ مِثْلُ حَظِّ الْأُنثَيَيْنِ﴾
“For the male is the share of two females.”

Decimal Distribution (Total = 100)​


◄ Two sons (ʿaṣabah) → 50% (each 25%)
◄ Four daughters (ʿaṣabah) → 50% (each 12.5%)
