❖ Question

What do the respected scholars say regarding this case:

A man named Jamal Beg passed away. He left behind the following heirs:

◄ One wife
◄ Mother
◄ Father
◄ Two sons
◄ One daughter

According to the Shariah of Muhammad ﷺ, what is the prescribed share for each heir?

❖ Answer

Alḥamdulillāh, waṣ-ṣalātu was-salāmu ʿalā Rasūlillāh, Ammā baʿd!

Before distribution, three matters must first be settled from the deceased’s estate:

➊ Funeral and burial expenses are taken out.
➋ Any debts of the deceased are repaid.
➌ If a valid will has been made, it is executed from up to one-third (⅓) of the estate.

After these matters, the remaining estate is divided. For convenience, the estate is assumed as 1 Rupee.
