Is It Kufr to Justify Marriage with a Married Woman in Islam?

❖ Question:​


What is the ruling on a person who claims that it is permissible to marry a woman who is already married to someone else?


✿ Answer:​


A person who considers marriage with another man's wife as permissible is guilty of a grave offense. In fact, there is a serious fear of disbelief (kufr) regarding such a person, because he is denying a clear Qur’anic injunction.


❀ Allah ﷻ says:​


﴿وَالْمُحْصَنَاتُ مِنَ النِّسَاءِ﴾
“And [forbidden to you are] married women.”

📚 Surah al-Nisā’ (4): 24


This verse establishes that married women are absolutely unlawful for anyone other than their current husbands.


✅ Conclusion:​


① Declaring marriage with a married woman as permissible is a denial of a clear Qur’anic prohibition.
② Such a belief may lead one to kufr (disbelief).
No nikāḥ is valid with a woman who is already in a valid marriage contract with someone else.
