If Mahr Is Not Specified at Marriage, a Woman Receives Mahr al-Mithl

❖ If a Man Marries Without Specifying Mahr, the Wife Receives the Customary Mahr​

✿ Introduction​


In Islamic law, if a man marries a woman without determining a specified mahr (dowry), and then consummates the marriage, the woman is still entitled to a fair mahr, known as Mahr al-Mithl (the customary dowry given to women of similar status).


✿ Evidence from the Sunnah​


➊ A narration reports:​


The Prophet ﷺ arranged the marriage of a man and a woman, and no mahr was specified at the time. The couple consummated the marriage, and later, at the time of the man’s death, he gave his share of Khaybar to the woman as her mahr, appointing witnesses.

➋ Alqamah (رحمه الله) narrates:​


A question was posed to Ḥaḍrat Ibn Masʿūd (RA) regarding a man who married a woman without setting a mahr, and died before consummating the marriage. Ibn Masʿūd (RA) responded:


"She will receive a mahr equal to that of women of her status—without any increase or decrease.
Additionally, she will observe ʿiddah, and she is entitled to inheritance."


Upon hearing this, Ḥaḍrat Maʿqil bin Sinān (RA) stood and said:
“The Messenger of Allah ﷺ passed the same judgment in the case of Barwʿ bint Wāshiq.”
Ibn Masʿūd (RA) was pleased with this confirmation.

✿ Scholarly Views​


If no mahr was set, the woman is entitled to Mahr al-Mithl upon the husband’s death—whether consummation occurred or not.


Supported by:

Imam Aḥmad (رحمه الله), Imam Abū Ḥanīfah (رحمه الله), Imam Ibn Sīrīn, Imam Ibn Abī Laylā, and Imam Isḥāq (رحمهم الله).


✿ Opposing View​


Imam Mālik (رحمه الله) held that if consummation did not occur, the woman is only entitled to inheritance, not mahr, because mahr is compensation for intimacy.
According to one narration, Imam al-Shāfiʿī (رحمه الله) also supported this view.

✿ Preferred Opinion (Rājiḥ)​


The first view is stronger, as it aligns with the authentic narrations mentioned above.


Imam Ibn Qudāmah (رحمه الله) also upheld this position.

✅ Conclusion​


If a man marries a woman without specifying mahr, and then either consummates the marriage or dies, the woman is entitled to Mahr al-Mithl based on customary standards.
Even without consummation, she is also entitled to inheritance and must observe ʿiddah, as ruled by both the Sunnah and the Companions.
