Honoring Marriage Conditions in Islam: A Woman's Right to Seek Religious Education

❖ Question:​


If a condition is made at the time of marriage that is not contrary to Shari'ah—such as the woman stipulating that her husband will not prevent her from acquiring religious education after marriage—does it become necessary to fulfill such conditions?


❖ Answer:​


If a condition is made in accordance with the Shari'ah at the time of contracting Nikah, then it must be fulfilled. This is because Muslims are obligated to honor their conditions and agreements.


The Prophet Muhammad ﷺ also stated:


"The conditions by which you make intimate relations lawful are the most deserving to be fulfilled."

Therefore, if the woman stipulates at the time of marriage that she will pursue religious education after marriage, and the husband accepts this condition, then after marriage, it is obligatory upon the husband to fulfill this condition. He must fully support and cooperate with her in the pursuit of religious knowledge.


If the husband neglects or hinders her in this matter, then the wife should remind him, advise him with good intention and sincerity, and demand her right and the fulfillment of the agreed condition.
