From Where to Wear Iḥrām Again After Arriving in Makkah? Sharʿī Ruling

❀ From Where Should One Wear Iḥrām Again After Reaching Makkah? ❀


❖ Question​


If someone comes to Makkah from outside and later intends to perform another ʿUmrah:


  • Should he put on iḥrām from the miqāt, or from inside the Ḥaram, or from outside the Ḥaram?
  • If it is permissible to wear iḥrām from within the Ḥaram, then why was ʿĀ’ishah (رضي الله عنها) sent to Tanʿīm?
  • For one who comes from outside, what condition applies if he wears iḥrām from within the Ḥaram?
  • Does staying in Makkah for more than three days make him a resident (ahl Makkah)?

❖ Answer​


Al-ḥamdu lillāh, waṣ-ṣalātu wa-salāmu ʿalā Rasūlillāh, ammā baʿd!


✿ Where to Wear Iḥrām From?​


If a person has arrived in Makkah from outside and is now residing there, then if he wishes to perform another ʿUmrah, he may wear iḥrām from the place of his stay inside the Ḥaram.


The evidence is from the ḥadīth in Ṣaḥīḥ al-Bukhārī:


«فَهُنَّ لَهُنَّ وَلِمَنْ أَتَی عَلَيْهِنَّ مِنْ غَيْرِ أَهْلِهِنَّ مِمَّنْ كَانَ يُرِيدُ الْحَجَّ وَالْعُمْرَةَ»
(Bukhārī – Kitāb al-Ḥajj – Bāb Mihl man kāna dūna al-Mawāqīt)


"These miqāts are for their residents and for those who pass through them, other than their residents, intending Ḥajj or ʿUmrah."



✿ Why Was ʿĀ’ishah (رضي الله عنها) Sent to Tanʿīm?​


As for Umm al-Mu’minīn ʿĀ’ishah (رضي الله عنها) being sent to Tanʿīm, this was an exceptional case.


The Prophet ﷺ permitted her to perform ʿUmrah out of consideration for her feelings and intention, so he instructed her brother ʿAbd al-Raḥmān (رضي الله عنه) to accompany her to Tanʿīm, from where she entered iḥrām.


This does not establish a general rule; it was a special allowance.


✿ For Outsiders Staying in Makkah​


If a person comes from outside Makkah and stays there temporarily, then he may wear iḥrām for another ʿUmrah from where he resides within Makkah, so long as he is still within Makkah and not returning back towards the miqāt.


✿ Does Staying Over Three Days Make Him Ahl Makkah?​


There is scholarly difference on this matter.


The correct view is:
❀ Simply staying in Makkah for three days or more does not make a person a resident of Makkah.
Ahl Makkah are only those who are permanent residents of the city.


✅ Conclusion​


◈ A person who enters Makkah from outside may wear iḥrām for another ʿUmrah from his place of stay in Makkah.
◈ The case of ʿĀ’ishah (رضي الله عنها) was a special exception, not a general rule.
◈ Staying more than three days in Makkah does not make one a permanent resident (ahl Makkah).
