Does Touching a Woman Break Wudu? Shar‘i Guidance and Evidences

Does wudu break by merely touching a woman?
Al-ḥamdu lillāh, waṣ-ṣalātu wa-salāmu ʿalā Rasūlillāh. Ammā baʿd!
The correct view is that merely touching a woman does not break wudu, unless something is discharged as a result of that contact. This ruling is based on the following points:
❀ An authentic hadith mentions that the Prophet ﷺ kissed one of his pure wives and then went to prayer without performing wudu.
❀ The basic principle is that wudu does not break unless there is authentic and explicit Shar‘i evidence to prove it.
❀ Once a person attains purity according to Shar‘i guidelines, it can only be nullified by Shar‘i evidence.
If someone argues that Allah ﷻ says in the Qur’an:
﴿أَو لـمَستُمُ النِّساءَ﴾
Sūrah al-Mā’idah: 6
“Or you have touched women.”
The response is as follows:
❀ Here, “touching” means sexual intercourse, as narrated from Ibn ʿAbbās (RA).
In this verse, purification is divided into two main types:
◈ Original Purification (with water)
◈ Substitute Purification (tayammum)
Both of these have further subdivisions:
◈ Minor Purification (wudu)
◈ Major Purification (ghusl)
Minor Original Purification (Wudu):
﴿يـأَيُّهَا الَّذينَ ءامَنوا إِذا قُمتُم إِلَى الصَّلوةِ فَاغسِلوا وُجوهَكُم وَأَيدِيَكُم إِلَى المَرافِقِ وَامسَحوا بِرُءوسِكُم وَأَرجُلَكُم إِلَى الكَعبَينِ﴾
Sūrah al-Mā’idah: 6
“O you who believe! When you stand for prayer, wash your faces and your hands up to the elbows, wipe your heads, and wash your feet up to the ankles.”
Major Original Purification (Ghusl):
﴿وَإِن كُنتُم جُنُبًا فَاطَّهَّروا﴾
“And if you are in a state of janābah, then purify yourselves.”
Substitute Purification (Tayammum):
﴿وَإِن كُنتُم مَرضى أَو عَلى سَفَرٍ أَو جاءَ أَحَدٌ مِنكُم مِنَ الغائِطِ أَو لـمَستُمُ النِّساءَ فَلَم تَجِدوا ماءً فَتَيَمَّموا﴾
Sūrah al-Mā’idah: 6
“And if you are ill, or on a journey, or one of you comes from the toilet, or you have had intercourse with women, and you do not find water, then perform tayammum.”
From this verse, three points are extracted:
➊ Tayammum is the substitute purification.
➋ ﴿أَو جاءَ أَحَدٌ مِنكُم مِنَ الغائِطِ﴾ — refers to the cause of minor purification.
➌ ﴿أَو لـمَستُمُ النِّساءَ﴾ — refers to the cause of major purification.
If “lamasa” simply meant physical touch, it would imply that Allah mentioned two causes for minor purification but omitted the cause for major purification, which contradicts the eloquence and structure of the Qur’an — especially since major purification is clearly stated elsewhere:
﴿وَإِن كُنتُم جُنُبًا فَاطَّهَّروا﴾
Thus, in this verse, “touching women” means sexual intercourse, not mere contact.
◈ Minor Purification (wudu) — limited to four parts of the body (face, hands, head, feet)
◈ Major Purification (ghusl) — full body purification
◈ Tayammum (substitute) — only two parts (face, hands)
The stronger opinion is:
❀ Merely touching a woman — whether with desire or without — does not break wudu.
❀ Exception: If contact results in discharge:
◈ If semen is discharged → ghusl becomes obligatory.
◈ If pre-seminal fluid (madhy) is discharged → washing the private parts and performing wudu becomes obligatory.
