Distribution of Inheritance According to Shar‘i Principles: Sons, Daughter, and Grandchildren

Question​


A person named Wajihuddin passed away, leaving the following heirs:


✿ Two sons: Rab Rakha and Sain Rakha
✿ One daughter: Hoor
✿ Six grandsons and six granddaughters


Kindly explain, according to the Muhammadan Sharī‘ah ﷺ, how the inheritance should be distributed among them.


Answer​


الحمد لله، والصلاة والسلام علىٰ رسول الله، أما بعد!


It should be known that from the estate of the deceased Wajihuddin, the following order is to be observed:


➊ First, the expenses of shrouding and burial should be deducted.
➋ Then, if the deceased had debts, they must be paid.
➌ After that, if the deceased made any valid will, it will be fulfilled from up to one-third of the entire estate.
➍ After completing these matters, the remaining movable and immovable estate will be divided among the heirs, with the total estate assumed as 1 Rupee for calculation.


Division of Inheritance​


Estate of Wajihuddin = 1 Rupee

Note: 2 paisa remain. These should be divided into 5 shares: each son will receive 2 shares, and the daughter will receive 1 share.


Modern Percentage Distribution​


Total estate = 100


✿ 2 sons (as ‘asabah) = 80% → each gets 40%
✿ 1 daughter (as ‘asabah) = 20%
✿ 6 grandsons = deprived
✿ 6 granddaughters = deprived
