Debt on the Deceased and Lack of Prior Notification

Scenario: The Deceased Had Debt but Did Not Inform Before Death

If a deceased person had outstanding debt but did not disclose it before passing away, and the debt is established through legitimate Islamic testimony, it becomes incumbent upon the heirs to settle the debt from the deceased's estate before executing any will or distributing the inheritance.

In case of a dispute between the heirs and the claimants of the debt, the matter should be referred to the court for resolution.
