Can a Man Remarry His Divorced Wife After ʿIddah? Islamic Ruling Explained

❖ Question:​


A man gave his wife one revocable divorce (ṭalāq rajʿī) and did not reconcile. Six months have passed. Can he marry her again?


✿ Answer:​


Yes, he can marry her again, but only through a new marriage contract (nikāḥ jadīd), since the ʿiddah has passed without reconciliation.


❀ Qur’anic Evidence:​


وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ إِذَا تَرَاضَوْا بَيْنَهُمْ بِالْمَعْرُوفِ
(Al-Baqarah: 232)

“When you divorce women and they have fulfilled their term (ʿiddah), do not prevent them from remarrying their (former) husbands if they agree on reasonable terms.”



❀ Ḥadīth Reference:​


Narrated by Sayyidunā Maʿqil ibn Yasār (RA):
“I gave my sister in marriage. Her husband divorced her with a revocable divorce. When her ʿiddah ended, he proposed again. I said: By Allah! I will never marry her to you again. Then this verse was revealed...”
(Ṣaḥīḥ al-Bukhārī: 4529, Sunan Abī Dāwūd: 2087 – Isnāds Ḥasan)



✅ Conclusion:​


✔ After the ʿiddah ends without rajʿah (reconciliation), the previous marriage ends completely.
✔ To reunite, a new nikāḥ (with new proposal, acceptance, mahr, and witnesses) is mandatory.
✔ It is permissible, and the guardian (walī) should not obstruct this if both parties agree.
