Question: If a man or woman endows a piece of land in the name of a mosque, is it permissible to build houses for residential purposes or shops for rental income on that land?
Answer:
When a person endows a piece of land in the name of a mosque, it is permissible to build houses on that land that are linked to the mosque, such as for the residence of the imam, the muezzin, or the caretaker. These houses can also be rented out, and the rental income can be used for the mosque’s maintenance, repairs, and similar needs. Similarly, it is permissible to construct shops to be rented out so that the income generated can cover the mosque’s expenses.
However, care must be taken to ensure that the intended purpose of the mosque’s construction is not harmed in any way. For example, the space for worshippers in the mosque should not be narrowed or restricted.
